Terms of Service

In these Terms: “Platform” means the MysteryBoxAU website, mobile applications, and all associated services. “We”, “Us”, “Our” refers to MysteryBoxAU Pty Ltd. “User”, “You”, “Your” means the registered account holder. “Credits” means non-refundable virtual currency purchased on the Platform. “Mystery Box” means a digital product selection where an item is revealed through a cryptographic random process.

To use this Platform you must:

• Be at least 18 years of age.
• Be a resident of Australia.
• Have the legal capacity to enter into binding contracts.
• Not be prohibited from using such services under applicable law.
• Have not previously been banned or suspended from the Platform.

By registering, you represent and warrant that all of the above conditions are satisfied. We reserve the right to request proof of age at any time and to suspend accounts pending verification.

You must provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

You may only hold one account. Creating duplicate accounts, accounts on behalf of another person without authorisation, or accounts to circumvent a suspension are prohibited.

You must notify us immediately at legal@mysteryboxau.com.au if you suspect any unauthorised use of your account.

Credits are a non-refundable virtual currency used solely to open Mystery Boxes on the Platform. Credits have no monetary value, cannot be transferred between accounts, cannot be withdrawn as cash, and do not constitute a financial product or investment.

All purchases of Credits are final. We do not provide refunds for Credits except where required by the Australian Consumer Law (ACL). To the extent permitted by law, all Credits purchases are non-reversible once applied to your account.

Prices for Credits are displayed in Australian Dollars (AUD) and include GST where applicable. We reserve the right to adjust pricing at any time without notice.

Payments are processed by Stripe, Inc. You must agree to Stripe's terms of service. We do not store your payment card details.

Mystery Boxes are a randomised product selection. Opening a Mystery Box is governed by our Provably Fair algorithm described at mysteryboxau.com.au/fairness.

Each Mystery Box displays the full list of possible prizes and their corresponding probability weights before purchase. You acknowledge and accept these probabilities before opening any Box.

Prizes won are subject to availability. Where a prize becomes unavailable, we reserve the right to substitute an item of equal or greater value or refund the equivalent Credits.

Won prizes may be claimed in one of three ways:

• Physical prize: shipped to an Australian address within 3–7 business days. Shipping fees may apply.
• Digital prize: delivered electronically to your registered email address within 24 hours.
• Credit sell-back: exchange the prize for Credits at the displayed sell-back rate.

Prizes must be claimed within 20 days of winning. Unclaimed prizes expire and are forfeited without compensation. You are responsible for providing accurate shipping information — we are not liable for non-delivery resulting from incorrect details.

You must not:

• Use automated scripts, bots, or software to interact with the Platform.
• Attempt to manipulate, reverse-engineer, or exploit the random roll system.
• Share, sell, or transfer your account or Credits to another person.
• Use the Platform for money laundering or other illegal financial activities.
• Harass, threaten, or abuse other users or Platform staff.
• Upload malicious code or attempt to compromise Platform security.
• Create an account while under the age of 18 or while previously banned.
• Attempt to circumvent any security, fraud-detection, or eligibility controls.

Violation of these prohibitions may result in immediate account suspension, forfeiture of Credits and prize claims, and referral to law enforcement where appropriate.

All content on the Platform — including but not limited to text, graphics, logos, user interfaces, and code — is owned by or licensed to MysteryBoxAU Pty Ltd and is protected by Australian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes. You must not reproduce, redistribute, or create derivative works without our written consent.

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to modify or discontinue any feature at any time without notice.

To the fullest extent permitted by the Australian Consumer Law and other applicable law, our total liability to you for any claim arising out of or in connection with these Terms or the Platform shall not exceed the total amount of Credits purchased by you in the 12 months preceding the claim.

We are not liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.

Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms. By using the Platform, you consent to our collection and use of your information as described therein.

If you have a dispute with us, please contact our support team at legal@mysteryboxau.com.au in the first instance. We will endeavour to resolve disputes informally within 30 days.

If a dispute cannot be resolved informally, either party may refer the matter to the Queensland Civil and Administrative Tribunal (QCAT) or other appropriate alternative dispute resolution process.

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland, Australia for all matters arising under or in connection with these Terms.

We may update these Terms at any time. Where changes are material, we will notify registered users by email at least 14 days in advance. Continued use of the Platform after the effective date of changes constitutes acceptance of the revised Terms.
